    I've been listening to rumors and allegations for as long as the Commission of Indian Affairs has been in effect. I haven't actually verified this, but I've heard that the reason TDA 4-34-1## is in the shape it is in is because allegedly Terry Ellenwood and tom kunesh rewrote it to say what it currently says.

    So, if the rumors are true, thank you mr kunesh.

    the original 1983 legislation that started the Tennessee Commission
    of Indian Affairs, Public Chapter No. 425:

    Section 3. (9): to establish appropriate procedures to provide for legal recognition by the state of presently unrecognized groups and to provide for official state recognition by the commission of such groups.

    and calling or recognizing yourself (and others who are NOT) an Indian when you are NOT will NOT make you an Indian either.

    Wave feathers around, wear Minetonka mocs, put on made-up clothing, speak a few words in languages not your own or of the relatives you claim to descend from,, gather in a group and call yourselves whatever you want ... it still does NOT legitimize you or your fantasies.

    Tennessee Legislature Adjourns


    Nashville, Tennessee, 10 June 2010 The Tennessee State Legislature adjourned sine die on 10 June 2010. Thus fulfilling the call of Anti-Indigenous American Indian entities and persons by sunsetting the Tennessee Commission of Indian Affairs


    The Tennessee Commission of Indian Affairs Establishes Procedures for Recognition

    Memphis, TN, 19 June 2010 – Pursuant to Tennessee Code Annotated 4-34-103(6) and 4-34-106-(m) The Tennessee Commission of Indian Affairs has established procedures to provide for legal recognition by the state of presently unrecognized tribes, nations, communities or individuals. This is a significant event in the life of Tennessee Indigenous American Indians.

    The Chikamaka Band was one of six (6) Tennessee Indigenous American Indian Tribes recognized.

    The Tennessee Commission of Indian Affairs (TCIA) voted unanimously (6-0) to approve six culture clubs as Native American Indian tribes at its meeting in Memphis Saturday.

    At its meeting the state agency, due to terminate in 10 days, first approved a new Standing Rule, number 14, "Procedures to provide for legal recognition by the state of presently unrecognized tribes, nations, groups, communities or individuals (TCA §4-34-103)", then opened the application process and began evaluating applications from six groups. A half hour after the evaluation process began, the six members present of the seven-member TCIA, Jimmie Thigpen, Charles Lawson, Tammera Hicks, James Meeks, Alice Henry, Christine Goddard -- four of whom are members of the culture clubs -- unanimously approved recognition of the groups:

    • United Eastern Lenape Nation of Winfield
    • Cherokee Wolf Clan of Yuma
    • Chickamauga Band of Tracy City
    • Central Band of Cherokee aka Cherokee of Lawrence County
    • Remnant Yuchi Nation of Kingsport
    • Tanasi Council of Far Away Cherokee of Memphis

    State agencies are required to follow state uniform administrative procedures to create new rules. Last year and this year the TCIA approved Rule 0785-1 Recognition Criteria for Tribes in the state but the Rule was stayed until after the TCIA sunset. Without the chance of using the new Rule 0785 next month, the TCIA is attempting state tribal recognition through internal procedures.

    Another TCIA meeting is scheduled for next Saturday, 26 June, during which the TCIA will presumably review and approve recognition of individuals as Native American Indians in Tennessee.

    Any action regarding 'recognition' is illegal; cannot be done. It's not an official act by any state agency with the power of authority to bestow such. IF there is any form of recognition, it's in 'name' only by an agency that will expire in about a week - as will its Rules. It would be fair to say that these 'tribes' are "paper indians" only.

    U all do not know all u think u know!!! If we are not valid then why all the nastiness??? Schwimmer sure knows has even been involved with some of our TRIBES. We have always been here. You out of state ndns or WANNABES should go somewhere that you can continue your fight against recognition. It's done here in TN!

    I was all set to keep my mouth out of this but this is a "FYI" moment.
    I was born In Tennessee. I grew up in Tennessee. I went off to the Army from Tennessee. I served this state honorably for many, many years in the Tennessee Nat'l Guard.
    I built my home in Tennessee. I raised a son in Tennessee. I pay taxes and vote in Tennessee. Don't tell me or any of my hundreds local friends who oppose this illegal recognition that we have no right to complain.
    Here to stay? You planted a tree on a stone. Will it live?????????????

    We'll see how things work out in a week or so. If state recognition is so great then why do state recognized tribes even bother with federal recognition? And, btw, one is not a step to the other. The BIA is not easily fooled.

    What would YOU think of groups of people who claim to be relatives but who've never had any connection to you, constantly showing up on your doorstep with their hands out 'cause rumor was, YOU had TONS of money laying around. You kept telling them you don't have "extra money" to be handing out to total strangers but they keep coming and keep begging. You tried to get them to move on but THEY refused and keep demanding money. And even more groups of alleged relatives kept coming, claiming to be your relatives while demanding money and they ALL wanted you to acknowledge them as your relatives. They ALL refused to go away although YOU knew (know) they are NOT your relatives.

    How about the issue with "illegal" immigration: "illegal aliens" coming here, claiming to be Americans to make money 'cause they heard there was TONS of money laying around for them to have. They wouldn't accept NO for an answer ... so here they are, making money while claiming to be Americans, taking all the good jobs, getting benefits, and health care while everyone else is saying NO, NO, NO!! They are NOT US citizens; they don't meet the citizenship requirements, they are NOT entitled to ANything and certainly not whatever "extra money" there might be!!

    Wouldn't YOU be UPSET?!!

    So "Schwimmer" 'knows' and has 'been involved with some of your' groups .... and THAT means WHAT and to WHOM?!! Were you trying to impress someone by "name dropping"?!! Lotsa folks been fooled by "Manataka" and others like that group also. So what? Appearances can be quite deceiving until the truth is seen.

    "Out of state" and wannabes .... you shoot yourselves in the foot by dismissing and denying those YOU claim as relatives of YOUR alleged ancestors.

    The only "wannabes" in the state are those who've been demanding to be 'recognized' as something they cannot be: Indians.

    Those of us fighting bogus 'recognition' aren't 'wannabes' 'cause we SURE do NOT wannabe YOU - or even LIKE you (your kind who live on Fantasy Island).



    BUH and it's not "done here in TN"; it's not even begun yet!
