    What else the new TCIA is not reporting: moving forward w/state Tribal Recognition

    this past saturday the new members of the TCIA voted to push forward with
    the existing proposed Tribal Recognition Criteria rules that the
    Commission has been working on for years, and without any changes:

    - approved TCIA Proposed Rule 0785-1, unanimous (same as TCIA approved on
    10 October 2009 Chattanooga, no changes.) Rule will supposedly become
    effective 90 calendar days after chair signs (23 january 2010 - 23 april
    2010). get a copy at

    - TCIA is distributing applications for recognition to all requesting
    organizations (www.tncia.org/RecApplication_JEMDraft_03_NW.pdf - approved
    9 June 2007 Chattanooga)

    - TCIA is going to try to review & approve recognition applications of all
    six groups as state-recognized tribes at the 24 april 2010 TCIA meeting &
    Recognition Review Committee in Chattanooga - to make sure the groups get
    state tribal recognition before the Commission gets terminated on 30 june
    2010.


    remember what happened the last time:

    1. the Commission approved this rule on 17 march 2007.

    2. it went into effect in 24 June 2007.

    3. On 31 July 2007 the Joint Government Operations Subcommittee on Sunset
    Review of the Commission of Indian Affairs determined that the rule Chapter
    0785-1, Recognition Criteria for Native American Indians, was politically
    problematic, and recommended that the Commission of Indian Affairs not be
    extended beyond its sunset date of 30 June 2008.

    4. On 1 August 2007 the Legislative Rules Review Committee chairman
    directed the Commission to withdraw the new rule 0785-1 for the
    Commission’s best chances at political survival.

    5. Accordingly the Commission rescinded its Recognition Rule 0785-1 at its
    December 2007 meeting in order to both comply with the directive and live to
    propose the rule again at a later date.


    WHAT TO DO:

    1. get a copy of Rule 0785-01 Recognition Criteria For Native American
    Indians - (0785-01-.02 Recognition Criteria for Tennessee Native American
    Indian Nations, Tribes, or Communities) at

    and get familiar with it.

    2. learn about the 6 culture clubs that want to fake their way into
    becoming state-recognized tribes by legislation or TCIA, aka
    "Confederation of Tennesssee Native Tribes"

    - Remnant Yuchi Nation
    - Upper Cumberland Cherokee (also known as the United Eastern Lenape
    Nation)
    - Chikamaka-Cherokee Band of the South Cumberland Plateau
    - Central Band of Cherokee (also known as the Cherokee of Lawrence County)
    - Cherokee Wolf Clan
    - Tanasi Council of the Far Away Cherokee

    3. keep track of the near-dead-but-still-on-the-book legislation: HB239 by
