Message:   We’ve had a most unusual and interesting development here in Delaware. I don’t think I have seen the likes of it before.

Senate Bill 174 was introduced last year which would require individuals under the age of 18 to wear helmets when operating bicycles, motorized scooters, and skateboards. Although philosophically opposed, we did not mount a huge effort against this bill, primarily because the sponsor also has control of the committee which would hear the mandatory motorcycle helmet law (Senate Bill 46). To date, this bill has been “desk-drawered” in committee, and we are hoping it stays that way through the end of this legislative session (June 30th).

But back to the child helmet law. It passed the Senate, and made its merry way to the House. An Amendment was added and passed which states in part:

The helmet requirement provisions of this section shall not apply to persons who object to the wearing of a helmet due to personal religious convictions.

Well, hardy har har har I say ! I have never seen this happen in any other State. I think it is a most unusual development.

The possibilities are endless. If this bill passes the Senate as amended, what are the connotations for SB 46? What legislative precedent would this set that could be used to totally muddle and obfuscate any attempt to pass the adult mandatory motorcycle helmet law ?

My own “personal religious convictions” are in a constant flux. More research must be done.
